Terms of Service

Overview

This website and the API served from api.capsolve.io (together, the "Service") are operated by capsolve.io. Throughout this document the terms "we", "us" and "our" refer to capsolve.io. We offer the Service, including all information, tools and APIs available from it, to you on the condition that you accept all terms, conditions, policies and notices stated here.

By creating an account, generating an API key or sending a request to the API, you agree to be bound by these Terms of Service ("Terms") and the Privacy Policy below. If you do not agree to all of them, do not use the Service. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind it to these Terms.

Section 1 – Eligibility and accounts

You must be at least 18 years old and legally able to enter into a contract to use the Service. You may not use the Service for any illegal or unauthorised purpose, and you must not transmit any worms, viruses or other destructive code through it.

Your account is identified by your Telegram username. Register only with a Telegram username you control. You are responsible for keeping your password and API keys confidential and for everything that happens under your account. Revoke a key from the dashboard as soon as you suspect it was exposed.

We do not collect an email address. If you lose your password, contact us through our support page (Telegram) from the Telegram account you registered with. We reset a password only after verifying that you control that account.

Section 2 – General conditions

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell or resell any part of the Service, use of the Service, or access to the Service without our express written permission. You may not share, sell or publish your API keys, or use another customer's keys.

Section 3 – Accuracy, completeness and timeliness of information

Results returned by the API come from third-party websites and services and are provided as they are received. We do not guarantee that any result is accurate, complete or current, or that a result will be accepted by a third-party website. Any reliance on results is at your own risk.

Section 4 – Modifications to the Service and prices

Prices are listed per API on the pricing page and may change. A new price applies only to requests made after it is published and never to requests already completed. We may add, change, suspend or retire any API at any time. Each API shows its current status on the website (Online, Offline, Maintenance or Coming soon); requests to an API that is not online are rejected and not charged.

Section 5 – API services

Each API is described on its own page, including its parameters, limits and price. We may apply rate limits, concurrency limits and request size limits to protect the Service. Some APIs run as asynchronous tasks; task results are kept for up to one hour after completion and then deleted.

Section 6 – Balance, billing and account information

  • Prepaid balance. The Service is pay-as-you-go. You add balance in advance, denominated in US dollars, by paying a cryptocurrency invoice through our payment processor, OxaPay.
  • Charges. Each successful request deducts the listed price of that API. The price is reserved when a request starts and returned automatically if the request fails, times out or is interrupted. Failed requests are never charged.
  • No cash value. Balance is not a deposit or a bank account, earns no interest and can only be used for the Service. It does not expire while your account is open.
  • Taxes. You are responsible for any taxes that apply to your purchases where you live.

Section 7 – Refund policy

  • You can ask for a refund of unused balance within 14 days of the top-up it came from. Balance already spent on successful requests is not refundable. When your balance comes from several top-ups, spending is counted against the oldest top-up first.
  • Refunds are paid in USDT (or, at our discretion, in the coin you paid with) to a wallet address you provide, minus the network fee for the transfer.
  • If you send less than an invoice amount, OxaPay does not mark it as paid; contact support with the order ID and we will credit or refund the amount received, minus network fees. Payments confirmed after an invoice expired are credited to your balance.
  • Crypto payments cannot be charged back. To request a refund, contact us through our support page with the order ID from Dashboard → Billing. We aim to reply within 2 business days and to pay approved refunds within 7 days.

Section 8 – Third-party links and services

The Service may link to or interact with third-party websites and services, including the websites you send requests to and our payment processor. We are not responsible for their content, policies or practices, and your use of them is at your own risk and subject to their terms.

Section 9 – Personal information

Your submission of personal information through the Service is governed by the Privacy Policy below.

Section 10 – Errors, inaccuracies and omissions

Occasionally there may be information on the website or in the API that contains errors, for example in prices, descriptions or availability. We reserve the right to correct any errors and to change or update information at any time without prior notice.

Section 11 – Prohibited uses

You may use the Service only for lawful purposes and only against websites and systems you are entitled to access in the way you access them. Following the laws and the terms of the websites you interact with is your responsibility. You may not use the Service to:

  • break any applicable law or regulation, or infringe the intellectual property or other rights of others;
  • access accounts, data or systems without authorisation, including logging in with credentials that are not yours;
  • commit or facilitate fraud, including payment fraud, fake sign-ups, fake reviews or manipulation of votes, promotions or rankings;
  • send spam or create accounts in bulk for abusive purposes;
  • disrupt, overload or degrade any website, network or service, including ours;
  • collect or process personal data unlawfully;
  • distribute malware, or access or distribute illegal content;
  • carry out security testing against systems you are not explicitly authorised to test;
  • probe or bypass our rate limits, billing or security controls.

We may rate limit, suspend or terminate your access for violating any of the prohibited uses. To report abuse, contact us through our support page with the relevant times, URLs and request IDs.

Section 12 – Disclaimer of warranties; limitation of liability

We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, or that any particular request will succeed. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for all claims relating to the Service is limited to the amount you paid us in the three months before the event giving rise to the claim.

Section 13 – Indemnification

You agree to indemnify, defend and hold harmless capsolve.io from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your violation of the rights of a third party.

Section 14 – Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed. This does not affect the validity and enforceability of any remaining provisions.

Section 15 – Termination and account deletion

Obligations and liabilities incurred before termination survive the termination of this agreement.

Deleting your account. You can delete your account at any time from Dashboard → Account. Deletion is immediate and cannot be undone: your API keys stop working, you are signed out everywhere, and your Telegram username is released. Any remaining balance is forfeited on deletion, so request a refund of eligible unused balance (Section 7) before you delete your account. What happens to your data is described in the Privacy Policy, Section 9.

Termination by us. We may suspend or terminate your account without notice if we reasonably believe you have failed to comply with these Terms, if your use creates a security or legal risk, or if required by law. If we terminate your account without cause, we refund your unused balance. If we terminate it for a breach of Section 11, unused balance may be withheld to the extent permitted by law.

Section 16 – Entire agreement

These Terms and the Privacy Policy, together with any policies we post on this website, are the entire agreement between you and us and supersede any prior agreements, communications and proposals relating to the Service. Our failure to exercise or enforce any right does not waive that right.

Section 17 – Changes to these Terms

We may update these Terms at any time by posting the new version on this page. We will change the date at the top and, for material changes, give reasonable notice on the website or in the dashboard. Continuing to use the Service after changes take effect means you accept them.

We do not store the parameters you send to the API or the results of synchronous requests. They pass through our gateway to the service that processes them and are not written to our database or logs. We never see or hold the private keys of your crypto wallet.

Section 2 – Consent

When you create an account or add balance, you consent to us collecting and using the information above for that purpose. We do not send marketing messages. You can withdraw your consent at any time by deleting your account (Section 9) or by contacting us through our support page.

Section 3 – Disclosure

We may disclose personal information if we are required by law to do so, or if you violate our Terms of Service. We do not sell personal information.

Section 4 – Service providers

We use a small number of providers to run the Service. They process data only on our behalf:

  • OxaPay: crypto payment processing. It receives the invoice amount and order ID when you add balance.
  • Our hosting provider: servers and storage for the website, API and database.
  • Upstream processing servers: receive the parameters of your API requests only to process them.

Section 5 – Third-party services

Third-party providers, such as OxaPay on its payment page, collect and use your information under their own privacy policies. Once you leave our website or are redirected to a third-party page, you are no longer governed by this Privacy Policy.

Section 6 – Cookies and similar technologies

We use one strictly necessary session cookie to keep you signed in (and a separate one for administrators). We do not use analytics, advertising or tracking cookies. Your browser's local storage remembers small preferences, such as light or dark theme and your preferred code language.

Section 7 – Age of consent

By using the Service you confirm that you are at least 18 years old. We do not knowingly collect information from anyone under 18.

Section 8 – Customer data purpose limitation

We use your data only to provide the Service you signed up for: authenticating requests, billing, support and keeping the Service secure. We do not use it for unrelated purposes.

Section 9 – Data retention and deletion

Request metadata is deleted after 90 days and task results after 1 hour. When you delete your account from Dashboard → Account:

  • your API keys, sessions, request history and task results are deleted immediately;
  • your Telegram username and password are removed and the username becomes available again;
  • payment and balance records are kept, without your username, only as long as accounting law requires;
  • deleted data also disappears from database backups as they rotate out (by default within two days).

You can also ask us to access or delete your data by contacting us through our support page from the Telegram account you registered with.

Section 10 – International transfers

Our servers and providers may be located outside your country. Where required, we use appropriate safeguards for international transfers of personal data.

Section 11 – Changes to this Privacy Policy

We may modify this Privacy Policy at any time. Changes take effect when they are posted on this page, and we will update the date at the top.
